Questions people actually ask

Is this going to replace me?

No, and it cannot. BIMvel does not make design decisions. It does not know your client, your code requirements or your office standards. What it does is the mechanical part, the four hundred clicks between deciding something and having it in the model. You are still the one deciding what gets built.

Do I need to know C# or the Revit API?

No. You describe what you want in normal language and BIMvel handles the code. You never have to write or read a line of C#.

What if it does something wrong to my model?

Every run is a single named Revit transaction, so one Ctrl+Z removes all of it. If the API throws part way through, the transaction rolls back instead of leaving half finished geometry. That said, AI results vary and can be wrong, so save and back up before running anything on live project work, and check the result the way you would check a graduate's.

Can I keep working while it generates?

Yes. Claude does its reading and writing outside Revit, so while a request is in flight you can carry on modelling, or switch to a second project entirely. Revit is only occupied during the execution step itself, which is short. A lot of people run one project's admin work through BIMvel while they design in another.

Is my project data sent to the cloud?

Your .rvt file never leaves your machine. What does get sent to the AI provider is your prompt plus the specific model information needed to answer it, such as level names, type names and the parameters you asked about. We do not store your project data and we do not train on it. If you work under an NDA, check with your client before putting identifying project information into any AI tool, including this one. Details are in the privacy policy.

Do I pay for Claude separately?

Yes. Your BIMvel license covers the plugin. The AI itself runs on Anthropic's Claude, which you access with your own Claude Desktop plan or Anthropic API key, billed by Anthropic. We do not mark that up and we do not resell it, and usage limits are set by them.

What does "one-time" actually cover?

A perpetual license to the major version you buy, including all updates and fixes within it. It does not expire and there is no recurring charge. A future major version may be a paid upgrade, and if it is, existing customers get an upgrade price rather than full price.

Which license do I need for client work?

Professional or Studio. Personal and Educational licenses are non-commercial only, fine for learning, coursework and your own experiments, but not for paid or client projects.

Can I get a refund?

Refund requests are accepted within 7 days of purchase, mainly where a technical problem stops the plugin working on a supported system. Read the refund policy before you buy so you know exactly what is and is not covered.

Terms of Service and End User License Agreement

These Terms of Service and End User License Agreement (the "Agreement") are a binding legal contract between you ("you", "your", the "Licensee") and DOMAS GRABAUSKAS, Essex County, Massachusetts, United States ("DOMAS GRABAUSKAS", "we", "us", "our"), the developer and licensor of the BIMvel plugin. Contact: support@bimvel.com.

Please read this before you buy or install

This Agreement contains provisions that materially limit your rights and DOMAS GRABAUSKAS's obligations. In particular, please read:

  • Section 9, under which the Software executes automatically generated program code inside your Revit session and you accept the risk of doing so;
  • Sections 10 and 11, under which artificial intelligence output may be wrong and you, not DOMAS GRABAUSKAS, are professionally responsible for everything you issue, build from or rely on;
  • Sections 21 to 25, which disclaim all warranties, cap our total liability at the amount you paid, require you to indemnify us, and impose a one-year deadline on claims;
  • Section 28, which requires most disputes to be resolved by binding individual arbitration and waives your right to a jury trial and to participate in a class action. Section 28.6 explains how to opt out of arbitration within 30 days.

If you do not accept these terms, do not purchase, download, install or use the Software.

1. Definitions

2. Acceptance, eligibility and authority

2.1 By purchasing, downloading, installing, activating, accessing or using the Software, or by clicking any control indicating acceptance, you agree to be bound by this Agreement. If you do not agree, do not use the Software and request a refund in accordance with Section 19.

2.2 You represent that you are at least 18 years old (or the age of majority where you live) and have full legal capacity to enter into this Agreement.

2.3 If you accept this Agreement on behalf of a company, firm, practice, institution, partnership or other entity, you represent and warrant that you have actual authority to bind that entity, and "you" refers to both you personally and that entity, which is jointly and severally responsible for compliance with this Agreement.

2.4 This Agreement applies to every license tier, including free trials, evaluation copies, Educational licenses and Beta releases, whether or not any fee was paid.

3. What the Software is, and what it is not

3.1 The Software is a productivity and automation tool. It acts as a bridge that lets an AI Provider read information from, and issue commands to, a Revit session running on your own computer, under your own user account and with your own permissions.

3.2 The Software is not, and must never be treated as: architectural, engineering, structural, civil, geotechnical, MEP, fire, life-safety, accessibility, environmental, surveying, quantity-surveying, cost, legal, insurance or regulatory-compliance advice; a design professional; a licensed practitioner; a code-checking, code-compliance or plan-review system; a substitute for professional judgement, review, coordination, calculation or sealing; a quality assurance system; a safety-critical system; or a system of record.

3.3 No professional-client, fiduciary, agency, partnership, joint-venture or employment relationship is created between you and DOMAS GRABAUSKAS by this Agreement or by your use of the Software. DOMAS GRABAUSKAS is not a design professional, is not a member of your project team, and does not review, check, approve or take responsibility for any project on which the Software is used.

3.4 The Software must not be used in, and is not designed, tested or certified for, any application where failure, error or inaccuracy could result in death, personal injury, or severe physical, environmental or property damage, including life-support, emergency response, nuclear, aviation, mass-transit, or any safety-critical control system. Any such use is entirely at your own risk and is a breach of this Agreement.

4. License grant

4.1 Subject to your continuing compliance with this Agreement and payment of the applicable fee, DOMAS GRABAUSKAS grants you a limited, perpetual (as defined in Section 6), non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software in object-code form, limited to the number of Seats purchased, for the purpose permitted by your license tier:

4.2 The Software is licensed, not sold. DOMAS GRABAUSKAS and its licensors retain all right, title and interest in and to the Software, including all copyright, patent, trade secret, trademark and other intellectual property rights. All rights not expressly granted in this Agreement are reserved.

4.3 Using the Software outside the scope of your license tier is both a breach of contract and, to the extent it involves copying or use beyond the license granted, copyright infringement.

5. Seats, license keys and activation

5.1 Your license key is confidential and personal to you or your organisation. Publishing, sharing, posting, reselling, sublicensing, leaking or otherwise distributing a key is a material breach, and we may deactivate the key immediately and without refund.

5.2 The Software contacts our licensing provider periodically to validate your key, record activations and enforce Seat counts. This validation requires an internet connection. You must not block, spoof, patch, emulate or otherwise circumvent license validation.

5.3 You are responsible for all use of the Software under your key, whether or not authorised by you, and you must notify us promptly if you believe your key has been compromised.

5.4 We may audit compliance with Seat counts on reasonable notice, no more than once in any twelve-month period, by requesting activation records from you. If an audit shows use in excess of Seats purchased, you must promptly purchase sufficient additional Seats at the then-current price.

6. What "perpetual" means, and updates

6.1 Your license covers the major version you purchased and all updates, patches and fixes released within that major version. It does not expire.

6.2 Future major versions may be offered as a paid upgrade. We are under no obligation to develop, release or provide any update, upgrade, new feature or new Revit version compatibility.

6.3 We may modify, suspend, limit or discontinue any feature, integration, Beta feature, licensing service, or the Software as a whole, and may discontinue sales or support of any version, at any time. Discontinuation does not revoke your right to keep using the version you already lawfully activated, but we do not warrant that any version will remain functional if a third party changes the Host Application, an operating system, an AI Provider service, or any API on which the Software depends.

6.4 Updates may change, remove or restrict functionality. Continued use after an update constitutes acceptance of the updated Software.

7. Restrictions

Except to the extent a restriction is expressly prohibited by applicable mandatory law, you may not, and may not permit or assist any third party to:

8. Acceptable use and your own compliance

8.1 You are solely responsible for ensuring your use of the Software complies with all laws, regulations, codes, standards, professional rules, licensing-board requirements, employer policies, client contracts, procurement rules and insurance conditions applicable to you.

8.2 Many jurisdictions, clients, public authorities and professional bodies restrict or require disclosure of the use of artificial intelligence in the production of design and construction documents. It is your responsibility, not ours, to determine what you must disclose and to whom, and to obtain any consent required before using the Software on a project.

8.3 You are responsible for determining whether your professional indemnity, errors and omissions, or other insurance covers work produced with AI assistance, and for notifying your insurer if required.

9. Automated code execution — acknowledgement and assumption of risk

9.1 You acknowledge and expressly accept that the Software works by executing automatically generated program code. When you issue an instruction, an AI Provider produces Generated Code which the Software then runs inside your Revit session, on your computer, under your user account, with your permissions.

9.2 Generated Code is written by a probabilistic system, not by a human engineer, and is not individually reviewed, tested, audited or approved by DOMAS GRABAUSKAS before it runs. It may contain errors, defects, infinite loops, unintended logic, or operations you did not intend or anticipate.

9.3 Generated Code executes with the same rights you have. Depending on the instruction given, it may create, modify, move, overwrite, purge or delete elements, types, families, views, sheets, parameters and worksets; alter or delete data in linked or worksharing-enabled models and central files; and read from or write to files on your computer, network drives or cloud-synced folders. You accept these capabilities as inherent to the product you are buying.

9.4 Transaction wrapping, undo and rollback are provided as a convenience and not as a guarantee. They may fail or be unavailable, and they do not reliably reverse operations outside the Revit transaction model, including file writes, exports, deletions, synchronisation to a central model, or changes propagated to linked or cloud-hosted models.

9.5 You are solely responsible for reviewing the intent of every instruction you issue, for supervising execution, for stopping a run you did not intend, and for the consequences of every instruction issued under your license key.

9.6 TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISK ARISING FROM THE EXECUTION OF GENERATED CODE, INCLUDING RISK OF MODEL CORRUPTION, DATA LOSS, FILE DELETION, LOSS OF WORK, AND DISRUPTION TO PROJECTS AND DEADLINES.

10. AI Output: accuracy, variability and no reliance

10.1 AI Output is generated by third-party artificial intelligence models. It is probabilistic and non-deterministic: identical instructions may produce different results on different runs, on different days, or after a model update by the AI Provider.

10.2 AI Output can be wrong. It may be inaccurate, incomplete, out of date, internally inconsistent, dimensionally incorrect, non-compliant with any code or standard, or entirely fabricated (commonly called "hallucination"), while nevertheless appearing plausible, confident and correct. DOMAS GRABAUSKAS makes no representation or warranty of any kind as to the accuracy, completeness, correctness, reliability, suitability, buildability, code-compliance, dimensional accuracy, or fitness for any purpose of any AI Output.

10.3 You must not rely on AI Output without independent verification. Every element, quantity, dimension, schedule, drawing, calculation, annotation and data value produced with the Software must be independently checked by a competent person before it is relied upon, issued, coordinated, priced, tendered, submitted for approval, or built from.

10.4 We do not control, and are not responsible for, the AI Provider's models, model versions, training data, system behaviour, safety filters, refusals, rate limits, latency, downtime, deprecations or pricing. Changes made by an AI Provider may change or degrade the Software's behaviour at any time without notice.

10.5 AI Output may resemble or coincide with material generated for other users or with pre-existing third-party material. We make no warranty that AI Output is original, novel, or free from third-party intellectual property rights, and you are responsible for satisfying yourself that your use of AI Output does not infringe the rights of others.

10.6 Ownership of AI Output, and whether it attracts copyright at all, may be unsettled or vary by jurisdiction. We make no representation about the legal status, protectability or ownership of AI Output.

11. Professional responsibility remains entirely yours

11.1 You are, and remain at all times, the responsible professional. Using the Software does not transfer, share, delegate, dilute or discharge any part of your professional, statutory, contractual or regulatory duty of care to any person, and does not make DOMAS GRABAUSKAS a designer, engineer, consultant, sub-consultant, checker or approver of any kind on any project.

11.2 You are solely responsible for: design intent and all design decisions; the review, verification, coordination, checking and approval of all output; compliance with all building codes, regulations, standards, planning conditions and accessibility requirements; structural, fire, life-safety and environmental adequacy; clash detection and coordination between disciplines; the accuracy of all quantities, schedules and cost information; the correctness of all issued documents; and the sealing, signing, certification and issue of any deliverable.

11.3 Output of the Software must be reviewed and approved by a suitably qualified and, where required by law, licensed or registered professional before use. If you are not such a professional, you must not use the Software to produce deliverables that require one.

11.4 DOMAS GRABAUSKAS does not, and cannot, know your client, your brief, your jurisdiction, your applicable codes, your office standards, your contractual obligations or your site conditions, and accepts no responsibility for any of them.

12. Backups, data loss and model integrity

12.1 You are solely responsible for maintaining complete, current, tested and independently stored backups of all Revit models, families, templates, central files and other data before and during any use of the Software. Do not use the Software on data you cannot afford to lose or on a model for which you have no recent backup.

12.2 We strongly recommend that you save your work, synchronise with central, and create a restore point immediately before issuing any instruction, and that you first exercise unfamiliar operations on a copy of the model rather than on live project work.

12.3 TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMAS GRABAUSKAS IS NOT LIABLE FOR ANY LOSS, CORRUPTION, DELETION OR ALTERATION OF MODELS, FILES, DATA, WORK PRODUCT OR PROJECT INFORMATION, HOWSOEVER CAUSED, INCLUDING WHERE CAUSED BY THE SOFTWARE OR BY GENERATED CODE. Your sole remedy for data loss is restoration from your own backups.

13. Third-party software and services

13.1 The Software is an independent add-in. It requires, and does not include: (a) a valid, separately purchased license of Autodesk® Revit® from Autodesk, Inc.; and (b) separately obtained and separately paid access to an AI Provider, currently Anthropic's Claude, via Claude Desktop, a Claude subscription or an Anthropic API key.

13.2 Your use of the Host Application is governed solely by your agreement with Autodesk, Inc. Your use of Claude or any other AI service is governed solely by your agreement with Anthropic PBC or the relevant AI Provider, including their usage policies, acceptable use policies and data-handling terms. Your purchase is governed additionally by the terms and privacy policy of the Merchant of Record. You are responsible for reading and complying with each of those agreements. Nothing in this Agreement modifies them, and if this Agreement conflicts with them in respect of those services, theirs prevails.

13.3 DOMAS GRABAUSKAS has no control over and accepts no responsibility or liability whatsoever for any third party, including Autodesk, Inc., Anthropic PBC, Lemon Squeezy, LLC, Microsoft, your operating system vendor, your cloud storage provider, your network, or any other add-in installed in your Revit session. This includes no responsibility for their availability, uptime, performance, latency, pricing, billing, usage limits, rate limits, quotas, suspensions, account terminations, security, data handling, model changes, API changes, deprecations, defects, or acts or omissions of any kind.

13.4 Third parties may change, restrict, deprecate or withdraw their APIs, models, license terms, pricing or products at any time, which may degrade or entirely prevent the operation of the Software. This is not a defect in the Software, and does not entitle you to a refund, replacement, compensation or damages.

13.5 All fees, charges, overages and usage costs of any AI Provider are billed to you directly by that provider. We do not resell, mark up, control, cap, monitor or refund them. You are solely responsible for all AI usage costs incurred under your account, including costs incurred by long, repeated, looping or unexpectedly large requests, whether or not you intended them.

14. Your relationship with Autodesk and the AI Provider

14.1 BIMvel is an independent product. DOMAS GRABAUSKAS is not affiliated with, endorsed by, sponsored by, certified by, partnered with, an agent of, or a reseller for Autodesk, Inc. or Anthropic PBC. Neither company has reviewed, approved, tested or validated the Software, and neither is a party to this Agreement.

14.2 Autodesk, Inc. and Anthropic PBC have no obligation whatsoever to you in respect of the Software, including no obligation to provide support, maintenance, updates, compatibility or warranty of any kind for it. Any support request concerning the Software must be directed to us, not to them.

14.3 You agree that you will not bring, and hereby waive, any claim against Autodesk, Inc. or Anthropic PBC arising out of or relating to your use of the Software, and that any claim you may have arising from the Host Application or an AI service lies against that provider under its own terms and not against DOMAS GRABAUSKAS.

14.4 Autodesk, Inc. and Anthropic PBC are intended third-party beneficiaries of Sections 3, 10, 13, 14, 21, 22, 23 and 24 and may enforce the disclaimers and limitations in them directly.

14.5 You warrant that your use of the Software does not and will not breach your Autodesk license agreement or the AI Provider's terms and usage policies, and that you hold all licenses, subscriptions and entitlements necessary for your use.

15. Organisational, firm and enterprise use

15.1 If the Software is used by or on behalf of a company, firm, practice, institution or other organisation, that organisation is fully and solely responsible for all use of the Software by its personnel, contractors and agents, and for all work product, deliverables, drawings, models and advice it issues, whether or not produced with the assistance of the Software.

15.2 The organisation is responsible for: authorising and supervising which of its personnel may use the Software; training them; setting and enforcing its own internal policies on AI use, review, checking and sign-off; ensuring competent professional review of all output; obtaining any client consent or disclosure required; maintaining adequate professional indemnity insurance; and complying with its own contracts with its clients.

15.3 Claims made against the organisation by its own clients, employees, consultants, contractors, insurers or any other third party are the organisation's responsibility alone. DOMAS GRABAUSKAS has no contractual relationship with, owes no duty of care to, and accepts no liability to your clients, your employer, your consultants, your contractors, your project stakeholders, or any other third party who receives or relies on your work product. Such parties acquire no rights under this Agreement.

15.4 The indemnity in Section 24 expressly extends to claims brought against DOMAS GRABAUSKAS by your clients or any other third party arising out of work you produced using the Software.

16. Your Content, confidentiality and data

16.1 You retain all right, title and interest in Your Content. We claim no ownership of your models, prompts or project output. You grant us only the limited, non-exclusive license to process Your Content as strictly necessary to operate the Software and provide support you request.

16.2 You represent and warrant that you own or have all rights, licenses and permissions necessary to submit and process Your Content through the Software and any AI Provider, and that doing so does not infringe any third-party right or breach any obligation you owe to anyone.

16.3 Operating the Software necessarily transmits your instructions, and the model information required to act on them, to the AI Provider. You are solely responsible for deciding what information you submit. Do not submit confidential information, personal data, security-sensitive information, export-controlled information, classified information, or anything covered by a non-disclosure agreement, unless you have confirmed that doing so is permitted under your own obligations and the AI Provider's terms.

16.4 If you are subject to GDPR, CCPA/CPRA, HIPAA, ITAR/EAR, government-security or similar regimes in respect of data you process, you are the controller or responsible party for that data and must carry out your own assessment before using the Software. We do not offer, and this Agreement does not constitute, a data processing agreement or business associate agreement.

16.5 Our handling of personal data is described in the privacy policy, which forms part of this Agreement.

17. Beta and experimental features

17.1 Features identified as Beta, preview, experimental or early access — including Photo-to-BIM and existing-conditions generation — are provided for evaluation only, "AS IS", with all faults, and with no warranty, support commitment or service level of any kind.

17.2 They are not guaranteed to be stable, accurate, complete, dimensionally correct or suitable for any purpose, must not be used for production, issued or construction work without full independent remodelling and verification, and may be changed, restricted or withdrawn at any time without notice, compensation or refund.

17.3 Any list of features on our website, in documentation, in marketing material or in a feature modal describes intended capability for information only. It is not a specification, warranty, representation or contractual guarantee, and availability varies by Revit version, edition, license, add-ins, content, template, worksharing configuration, regional settings and project setup.

18. Feedback

If you send us suggestions, ideas, bug reports, feature requests or other feedback, you grant DOMAS GRABAUSKAS a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify and commercialise that feedback for any purpose, without obligation, attribution or compensation to you. Do not send us feedback that is confidential or that you are not free to give.

19. Fees, taxes, payment and refunds

19.1 Purchases are processed by Lemon Squeezy, LLC, which acts as Merchant of Record and is the seller of record for your transaction. Their terms and privacy policy also apply to the payment, and their name appears on your statement.

19.2 All prices are in USD and exclusive of VAT, GST, sales and similar taxes, which are calculated and collected at checkout where applicable. You are responsible for any withholding or other taxes imposed on you.

19.3 Refunds are governed by our refund policy, which forms part of this Agreement. Because the Software is a digital product delivered immediately, and to the extent permitted by applicable law, you expressly request immediate delivery and acknowledge that you lose any statutory right of withdrawal or cooling-off period once download or activation begins.

19.4 You must not initiate a chargeback or payment dispute without first contacting us at support@bimvel.com and allowing a reasonable opportunity to resolve the matter. License keys associated with a chargeback or refund are deactivated, and you must uninstall the Software.

20. Support

Support is provided by email on a commercially reasonable efforts basis during our normal working hours. No response time, resolution time, uptime, availability or service level is guaranteed, and support is not available for: third-party software, the Host Application, AI Provider accounts or billing, unsupported Revit versions or editions including Revit LT, modified or cracked copies, conflicts caused by other add-ins, or the correctness of any AI Output.

21. Disclaimer of warranties

21.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE, ALL AI OUTPUT, ALL GENERATED CODE, ALL BETA FEATURES AND ALL SUPPORT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR ARISING FROM COURSE OF DEALING, USAGE OR TRADE PRACTICE.

21.2 DOMAS GRABAUSKAS AND ITS SUPPLIERS AND LICENSORS EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, SYSTEM INTEGRATION AND DATA ACCURACY.

21.3 Without limiting the above, we do not warrant that: the Software will meet your requirements or expectations; it will operate uninterrupted, timely, secure or error-free; defects will be corrected; it is compatible with any particular Revit version, edition, add-in, template, family, workset configuration or hardware; it will remain compatible with any third-party product or API; AI Output will be accurate, complete, correct, consistent, code-compliant, buildable, original or fit for any purpose; or that use of the Software will not cause changes, warnings, errors, corruption or loss within your Revit models or on your systems.

21.4 No advice or information, whether oral or written, obtained from DOMAS GRABAUSKAS, its website, its documentation, its marketing material or any AI Output creates any warranty not expressly stated in this Agreement.

21.5 Some jurisdictions do not allow the exclusion of implied warranties, so parts of this Section may not apply to you. Nothing in this Agreement excludes or limits any warranty, guarantee or right that cannot lawfully be excluded or limited, including non-excludable statutory consumer guarantees. Where such rights apply, our liability is limited, at our option and to the extent permitted, to re-supplying the Software or refunding the price paid.

22. Assumption of risk and release

22.1 You acknowledge that you have read Sections 3, 9, 10, 11 and 12, that you understand the nature and risks of automated, AI-driven modification of building information models, and that you knowingly and voluntarily elect to use the Software with full knowledge of those risks.

22.2 To the maximum extent permitted by law, you release, waive and discharge DOMAS GRABAUSKAS, its owners, officers, directors, employees, contractors, agents, suppliers and licensors from any and all claims, demands, damages, losses, costs and liabilities of every kind, known or unknown, arising out of or relating to the Software, AI Output, Generated Code, or any project, deliverable or decision made using them.

22.3 If you are a California resident, you expressly waive California Civil Code section 1542, which provides that a general release does not extend to claims that the creditor does not know or suspect to exist in their favour at the time of executing the release, and which if known would have materially affected the settlement. You waive equivalent provisions of any other jurisdiction.

23. Limitation of liability

23.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMAS GRABAUSKAS AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, OR FOR ANY:

whether based in contract, tort (including negligence), strict liability, statute or any other theory, and even if DOMAS GRABAUSKAS has been advised of the possibility of such damages, and regardless of whether any limited remedy fails of its essential purpose.

23.2 AGGREGATE CAP. THE TOTAL CUMULATIVE LIABILITY OF DOMAS GRABAUSKAS AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS AND LICENSORS, ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS AGREEMENT, FOR ALL CLAIMS COMBINED, SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID FOR YOUR LICENSE IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE FIRST CLAIM, OR (B) FIFTY US DOLLARS (US$50).

23.3 This cap is aggregate across all claims and claimants and is not multiplied by the number of Seats, incidents, projects or claims. Multiple claims do not enlarge it.

23.4 These limitations are a fundamental basis of the bargain between you and DOMAS GRABAUSKAS. The Software is licensed at a low, one-time price precisely because liability is allocated as set out in this Agreement; without these limitations, the price would necessarily be materially higher or the Software would not be offered at all. You acknowledge that you have had the opportunity to obtain your own insurance for the risks allocated to you.

23.5 Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct where such exclusion is not permitted, or for any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above may not apply to you.

24. Indemnification

24.1 You agree to defend, indemnify and hold harmless DOMAS GRABAUSKAS and its owners, officers, directors, employees, contractors, agents, suppliers and licensors from and against any and all claims, demands, actions, proceedings, investigations, liabilities, damages, judgments, settlements, fines, penalties, losses, costs and expenses (including reasonable legal fees and expert fees) arising out of or relating to:

24.2 We will notify you of any claim for which we seek indemnity, and you may control the defence with counsel reasonably acceptable to us, provided that you may not settle any claim in a way that imposes any obligation, admission or liability on us without our prior written consent. We reserve the right to participate in the defence at our own expense.

25. Time limit for bringing claims

To the maximum extent permitted by law, any claim or cause of action arising out of or relating to the Software or this Agreement must be commenced within ONE (1) YEAR after the claim or cause of action first accrues, or it is permanently barred. This does not apply where a shorter or longer period is mandated by non-excludable law applicable to you.

26. Termination

26.1 This license terminates automatically and immediately, without notice, if you materially breach this Agreement, including any breach of Sections 4, 5, 7 or 8.

26.2 We may also suspend or deactivate a license key where we reasonably suspect key sharing, license circumvention, fraud, chargeback abuse, or use that exposes us to legal liability.

26.3 On termination you must immediately cease all use of the Software, uninstall it from every system, and destroy all copies. Termination for breach does not entitle you to any refund and does not limit any other remedy available to us.

26.4 Survival. Sections 1, 3, 4.2, 4.3, 7 to 18 and 21 to 32 survive termination or expiry of this Agreement for any reason.

27. Export control, sanctions and government end users

27.1 The Software may be subject to United States export control and sanctions laws, including the Export Administration Regulations, and to the laws of other jurisdictions. You represent that you are not located in, ordinarily resident in, or organised under the laws of any country or territory subject to comprehensive sanctions, and that you are not a person listed on any restricted-party, denied-party or sanctions list.

27.2 You must not export, re-export, transfer or make the Software available in breach of any applicable export control or sanctions law, and must not use it for any prohibited end use, including any nuclear, chemical, biological weapons or missile technology application.

27.3 The Software is "commercial computer software" and "commercial computer software documentation" as those terms are used in FAR 12.212 and DFARS 227.7202. Any use, duplication or disclosure by or on behalf of the U.S. Government is subject only to the rights granted in this Agreement.

28. Dispute resolution, binding arbitration and class action waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AND LIMITS THE WAY YOU CAN SEEK RELIEF FROM DOMAS GRABAUSKAS. IT AFFECTS YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

28.1 Informal resolution first. Before commencing any arbitration or proceeding, you agree to contact us at support@bimvel.com with a written description of the dispute and the relief sought, and to negotiate in good faith for at least sixty (60) days. This is a condition precedent to commencing arbitration.

28.2 Binding arbitration. Any dispute, claim or controversy arising out of or relating to the Software or this Agreement, including its formation, interpretation, breach, termination, validity or enforceability, that is not resolved informally shall be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules or Commercial Arbitration Rules, as applicable. Arbitration shall be conducted by a single arbitrator, in the English language, seated in Essex County, Massachusetts, and may be conducted by documents only, by telephone or by video conference where the rules permit. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this Section.

28.3 CLASS ACTION AND JURY TRIAL WAIVER. YOU AND DOMAS GRABAUSKAS EACH WAIVE ANY RIGHT TO A TRIAL BY JURY AND AGREE THAT ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF, CLASS MEMBER OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of more than one person and may not preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall be severed and brought in court, and the remainder of this Section shall remain in force.

28.4 Exceptions. Either party may bring an individual action in small claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or to prevent unauthorised use, disclosure or infringement, without first complying with Sections 28.1 to 28.3.

28.5 Costs. Payment of filing, administration and arbitrator fees is governed by the applicable AAA rules. Each party otherwise bears its own legal costs unless the arbitrator determines otherwise under applicable law.

28.6 30-day opt-out. You may opt out of this arbitration and class-waiver Section by sending written notice to support@bimvel.com with the subject line "Arbitration Opt-Out", stating your name, purchase email and order number, within 30 days of your first purchase. Opting out does not affect any other provision of this Agreement, and we will not terminate your license for opting out.

28.7 If you are a consumer resident in a jurisdiction whose mandatory law does not permit pre-dispute binding arbitration or a class-action waiver, this Section applies to you only to the extent permitted by that law, and the remainder of this Agreement continues to apply.

29. Governing law and venue

29.1 This Agreement and any dispute arising from it are governed by the laws of the State of Massachusetts, United States of America, and, as applicable, the federal laws of the United States, without regard to conflict-of-law rules.

29.2 Subject to Section 28, the state and federal courts located in Essex County, Massachusetts shall have exclusive jurisdiction, and you consent to personal jurisdiction and venue there and waive any objection based on inconvenient forum.

29.3 The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act do not apply to this Agreement.

29.4 If you are a consumer, you retain the benefit of any mandatory consumer-protection provisions of the law of the country in which you are habitually resident that cannot be derogated from by agreement, and you may bring proceedings in the courts of that country where that law so requires.

30. Changes to this Agreement

We may update this Agreement for future purchases and for continued use of the Software. Material changes will be posted on this page with a new "last updated" date and, where we hold your email address and the change is significant, notified by email. The version in force at the time of your purchase governs that purchase, except that changes required by law, or made to Sections 7, 8 and 27, apply on posting. Continued use of the Software after a change takes effect constitutes acceptance of it.

31. Force majeure

DOMAS GRABAUSKAS is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disaster, fire, flood, epidemic, war, terrorism, civil unrest, labour dispute, government action, sanction, embargo, power or telecommunications failure, internet or hosting outage, cyber-attack, or the failure, change, suspension, deprecation or discontinuation of any third-party service, API, model or platform, including those of Autodesk, Inc., Anthropic PBC and Lemon Squeezy, LLC.

32. General

32.1 Entire agreement. This Agreement, together with the privacy policy and the refund policy, is the entire agreement between you and DOMAS GRABAUSKAS concerning the Software, and supersedes all prior or contemporaneous statements, proposals, marketing material, demonstrations, feature lists and understandings, whether written or oral. You confirm you have not relied on any statement, representation or warranty not expressly set out in this Agreement, except that nothing limits liability for fraudulent misrepresentation. Any purchase order or other document you issue has no effect and its terms do not apply.

32.2 Severability. If any provision is held invalid, illegal or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable while preserving its intent, or if that is not possible, severed. The remaining provisions remain in full force. In particular, if any limitation or exclusion of liability is held unenforceable, the remaining limitations continue to apply to the fullest extent permitted.

32.3 No waiver. No failure or delay in exercising any right is a waiver of it, and no waiver is effective unless in writing and signed by us. A waiver on one occasion does not waive any later breach.

32.4 Assignment. You may not assign, novate, transfer, sublicense or otherwise dispose of this Agreement or any license granted under it, by operation of law or otherwise, without our prior written consent; any attempt to do so is void. We may assign this Agreement freely, including in connection with a merger, acquisition, reorganisation or sale of assets.

32.5 No third-party rights. Except as expressly stated in Section 14.4, this Agreement confers no rights on any person who is not a party to it, and no third party may enforce any of its terms.

32.6 Relationship. The parties are independent contractors. Nothing creates a partnership, joint venture, agency, franchise or employment relationship.

32.7 Notices. Notices to us must be sent to support@bimvel.com and to our registered address. Notices to you may be sent to the email address associated with your purchase and are deemed received on the day of sending.

32.8 Interpretation. Headings are for convenience only. "Including" means "including without limitation". No rule of construction against the drafter applies. This Agreement was drafted in English; in the event of any conflict with a translation, the English version prevails.

32.9 Electronic contracting. You consent to contract electronically and agree that your acceptance by click, purchase, download, installation or use has the same legal effect as a handwritten signature.

33. Trademarks and attribution

Autodesk® and Revit® are registered trademarks of Autodesk, Inc. in the USA and other countries. Claude™ and Anthropic™ are trademarks of Anthropic PBC. Model Context Protocol is a specification published by Anthropic PBC. Lemon Squeezy is a trademark of Lemon Squeezy, LLC. Windows and .NET are trademarks of Microsoft Corporation. BIMvel and DOMAS GRABAUSKAS are independent of all of them. All trademarks are the property of their respective owners and are used here nominatively, solely to identify compatibility and interoperability, and not to imply any affiliation, sponsorship, endorsement or certification.

Order and invoice records are kept for as long as tax law requires, typically 7 to 10 years. License records are kept while your license is active. Support emails are kept for up to 3 years. Crash reports are kept for up to 12 months.

6. Cookies

This site sets no analytics or advertising cookies. The checkout provided by Lemon Squeezy sets cookies strictly necessary to process your payment. The demo video only loads from YouTube after you click play, so nothing is requested from YouTube before that.

7. Your rights

Depending on where you live, you may have the right to access, correct, delete, restrict or object to the processing of your personal data, to data portability, and to withdraw consent. To exercise any of these, email privacy@bimvel.com and we will respond within 30 days. If you are in the EEA or UK, you may also complain to your local data protection authority. If you are in California, we do not sell or share personal information as those terms are defined by the CCPA and CPRA, and we will not discriminate against you for exercising your rights.

8. Security

We use industry-standard measures to protect the data we hold, but no system is perfectly secure. If a breach affects your data, we will notify you and the relevant authority as the law requires.

9. Children

BIMvel is not directed at children under 16 and we do not knowingly collect their data.

10. Changes

We will post updates here with a new "last updated" date, and tell customers by email if the change is significant.

How to Request a Refund

To request assistance or a refund, contact DOMAS GRABAUSKAS at support@bimvel.com with your purchase email, order number, software version, Revit version, and a description of the issue. We may ask you to complete reasonable troubleshooting steps before a refund is approved.

Approved refunds are issued by Lemon Squeezy, LLC as Merchant of Record, to the original payment method. Your license key is deactivated when a refund is processed, and you must immediately stop using and uninstall the Software.

Please raise any problem with us before initiating a chargeback. Chargebacks initiated without contacting us first result in immediate and permanent deactivation of the license key.

This policy forms part of the Terms of Service and End User License Agreement, and the disclaimers and limitations in that agreement apply. Nothing in this policy limits rights provided under applicable non-excludable consumer law.
